Fatkidz Fantasy — Terms of Service Operated by CryptoCurrencyShops LLC ("CryptoCurrencyShops", "we", "us", "our"). By creating an account, accepting these Terms, or using Fatkidz Fantasy, you agree to them. If you do not agree, do not use the service. 1. THE SERVICE Fatkidz Fantasy provides fantasy-football analysis tools, including the Trade Calculator and, when released, the Dynasty War Room. The service produces estimates, rankings and comparisons generated by our models from third-party and derived data. It is an information and analysis tool only. 2. NO GUARANTEE OF OUTCOMES We do not guarantee any fantasy-football result, trade outcome, league finish, player performance, or any other outcome. Values, ratings, rankings and recommendations are estimates, not predictions or advice. You are solely responsible for every roster, trade, waiver, draft and league decision you make. Nothing in the service is financial, investment, wagering, tax or legal advice, and it is not intended for use in any activity where money is staked on an outcome. 3. DATA LIMITATIONS Player and statistical data may be delayed, incomplete, inaccurate, revised, restated or unavailable. Data may come from third parties we do not control. Player values are recalculated periodically and may change materially between updates. Some assets may carry no value on a given format. We do not warrant that any data or derived value is accurate, current or fit for any purpose. 4. ACCOUNTS You must provide a valid email address and keep your credentials confidential. You are responsible for all activity under your account. One account per person. You must be old enough to form a binding contract where you live. We may suspend or terminate an account that violates these Terms, is used to abuse the service, or is associated with fraudulent or unauthorized payment. 5. ACCEPTABLE USE You may not: resell, sublicense, or redistribute the service or its data; scrape, crawl, bulk-export or systematically extract values or player data; reverse engineer or attempt to derive our models; share one account across multiple people; interfere with, overload or probe the service or its infrastructure; bypass or attempt to bypass access, entitlement or payment controls; or use the service in violation of any applicable law. 6. SUBSCRIPTIONS AND BILLING Paid access is offered as a monthly subscription, an annual subscription, or a fixed-term three-year purchase, at the prices shown at checkout. Payments are processed by Stripe; we do not store your full card details. Recurring plans renew automatically at the then-current price for that plan until cancelled. You may cancel at any time through the billing portal; cancellation stops future renewals and access continues to the end of the paid period already purchased. The three-year purchase is a one-time payment granting access for the stated fixed term and does not renew. Taxes may be added where required. 7. REFUNDS All purchases are final and non-refundable. This is our default position and you should purchase on that basis. We may, entirely at our discretion and on a case-by-case basis, choose to end a customer's access early and issue a prorated refund for the unused portion of a term. Doing so in one case creates no obligation, entitlement or precedent in any other case, and nothing in this section is a promise of a refund. Statutory rights that cannot be waived under applicable law are unaffected. 8. DYNASTY WAR ROOM BONUS The three-year plan includes a complimentary promotional bonus of twelve months of Dynasty War Room access, beginning if and when Dynasty War Room is released to the public. This bonus is provided at no additional charge and is not part of the consideration for the three-year purchase. The price of the three-year plan is payment for Trade Calculator access for its stated term only. The bonus has no standalone or cash value, cannot be exchanged, transferred or redeemed for credit, and is not sold separately. Dynasty War Room is under development. We do not guarantee that it will be released, that it will be released within any particular timeframe, or that any specific feature will be included. If Dynasty War Room is never released, is delayed, is discontinued, or differs from what was anticipated, no refund, credit, extension or other compensation is owed for the bonus, and the three-year Trade Calculator access you purchased is unaffected. 9. PRIVACY AND DATA USE We collect the email address you register with, authentication and session data, records of your acceptance of these Terms including the version accepted and the time of acceptance, billing records and identifiers returned by our payment processor, and data you enter into the service such as saved teams and trade scenarios. We use this to operate and secure the service, provide paid access, communicate about your account, and meet legal obligations. We do not sell your personal information. Payment card details are handled by Stripe under its own terms and privacy policy and are not stored by us. We share data with service providers only as needed to run the service, and where required by law. We retain account and legal-acceptance records for as long as your account exists and afterwards as needed for legal, accounting and dispute purposes. You may request access to or deletion of your account data by contacting us; deletion of an active paid account ends access without refund except as described in section 7. A separate, more detailed privacy policy may be published, and where it conflicts with this section, the separate policy governs. 10. INTELLECTUAL PROPERTY The service, its software, interfaces, models, methodologies, derived values, rankings, documentation and branding are owned by CryptoCurrencyShops LLC or its licensors and are protected by intellectual property law. You receive a limited, personal, non-exclusive, non-transferable, revocable licence to use the service for your own fantasy-football purposes while your account is in good standing. No other rights are granted. Third-party names, statistics and marks remain the property of their owners and their use does not imply affiliation or endorsement. 11. THIRD-PARTY SERVICES The service depends on third parties, including our payment processor, data sources and hosting providers. We are not responsible for their acts, omissions, outages, pricing or terms. 12. CHANGES TO THE SERVICE We may add, change, suspend or discontinue any part of the service, including individual features, data sources, models and value methodologies, at any time. If we permanently discontinue a paid feature you are currently paying for, we will consider relief under section 7 at our discretion. 13. DISCLAIMER OF WARRANTIES The service is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that any value or projection is accurate. 14. LIMITATION OF LIABILITY To the fullest extent permitted by law, CryptoCurrencyShops LLC and its owners, officers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost league winnings, lost data or goodwill, arising out of or relating to the service, whether in contract, tort or otherwise, even if advised of the possibility. Our total aggregate liability for all claims relating to the service is limited to the amount you actually paid us for the service in the twelve months immediately before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions our liability is limited to the greatest extent permitted. 15. INDEMNITY You agree to indemnify and hold harmless CryptoCurrencyShops LLC from claims, damages, liabilities and reasonable legal costs arising from your use of the service, your content, or your breach of these Terms or applicable law. 16. TERMINATION You may stop using the service and cancel at any time. We may suspend or terminate access for breach of these Terms, suspected fraud, chargeback abuse, or where required by law. Sections that by their nature should survive termination, including sections 2, 3, 7, 8, 10, 13, 14, 15 and 17, survive. 17. GOVERNING LAW AND VENUE These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules. You and CryptoCurrencyShops LLC agree to the exclusive jurisdiction and venue of the state and federal courts located in North Carolina for any dispute arising out of or relating to these Terms or the service. 18. CHANGES TO THESE TERMS We may update these Terms. Each version carries a version identifier. When we publish a new version, you will be asked to accept it before continuing to use protected parts of the service. Your acceptance of a specific version is recorded with that version identifier. Continuing to use the service after accepting a new version means you agree to it. If you do not accept a new version, you may cancel; section 7 applies. 19.
